Labor believes that basic rights of innocent victims would be sacrificed in order for the big insurers to prop up their super-profits, which over the last two decades have been almost $10 billion.

The Baird Government is going out of its way to leave the insurers untouched - happy with a system where, according to its own data, more than $250 out of an average premium goes to insurers.

This radical restructure would change the principles of the Compulsory Third Party scheme introduced by Labor in the 1940’s.

The Baird Government’s proposal is even worse than the 2013 reforms – which were abandoned by the O’Farrell Government and led to the dismissal of the Minister at the time, Greg Pearce.

No privately underwritten, no fault scheme currently exists in any other part of the world, and the Baird Government is experimenting with the rights and protections of motorists who do the right thing.

Labor said that a better option would be to focus on fraud, tackle shonky lawyers and address insurer super profits.

Incremental changes and addressing profit gouging of insurers could deliver similar reductions in premiums, without trashing common law rights of innocent victims.

During Budget Estimates hearing this week, the Minister also could not address the desperate situations of innocent victims of accidents - like a 35 year old nurse with severed bowel and bladder – who will be left out of pocket as a result of the Government’s proposed changes.
